Neil Averitt commentary: Exclusive dealing: Is there more to come from the FTC?

(October 14, 2016) -- The torch of exclusive dealing enforcement has passed from the Department of Justice’s antitrust division to the Federal Trade Commission, and the question now is what the FTC intends to do with it. Are the agency’s two recent cases merely a matter of maintaining the received, relatively hands-off standards? Or are they designed to lay the foundation for a more aggressive effort to move the law? Either of these futures is possible....
