DOJ, FTC weigh in on appellate antitrust case

(June 17, 2013) -- After a panel of the U.S. Court of Appeals for the Eighth Circuit ruled that an antitrust divestiture decree involving a licensing agreement could be rejected under the Bankruptcy Code, the Court invited the government to present its views on the issue. The Federal Trade Commission and the Justice Department responded recently by filing a brief as amici curiae, in which they argued that the question raised is “of exceptional importance” to effective antitrust enforcement and that there should be a rehearing either by the panel or by the en banc Court....
