And both agencies have only finite resources of staff and money to put into investigations. The resulting workload raises a whole series of important practical questions: Are the agencies reaching the limits of their carrying capacity? Does that suggest that merging firms now have an opportunity to press for more favorable settlement terms than usual? And if that is so, what responses and countermeasures are available to the agencies?...
